Slovenia Votes To Reject Same-Sex Adoption Rights

Slovenia held a national referendum on whether the new Family Code should go into effect and rejected the measure after a campaign that focused on whether same-sex couples should gain the right to adopt children jointly as a couple.

Raw Story reports:

With over 99 percent of ballots counted, the results showed that 54.77 percent of voters rejected a proposed new family code while 44.23 percent backed it, the electoral commission of the eurozone member state announced.

“It remains to be seen what impact such a delay will have on children, families and the rest,” said Majda Potrata, deputy head of the opposition Social Democrats which led the previous government that drafted the bill.
Pre-referendum opinion polls had predicted an outcome of about 60 percent in favour of the proposed measure, with warnings that a low voter turnout would favour conservatives in the country of some two million people.
The commission said turnout was about 29.95 percent, lower than predicted by pollsters.
Under Slovenian law, if a bill is rejected in a referendum it cannot go back to parliament for another 12 months.
Conservative civil groupings backed by the Catholic Church had challenged the new Family Code passed by parliament in June 2011 and gathered the 40,000 signatures needed to force a referendum on its implementation.

Yet another example of heterosexual majority lying to pollsters and implementing their homophobia and protecting heterosexual privilege in the confines of the ballot box.

Shock! UTAH Gov Vetoes Anti-Sex Education Bill

Well, this is a surprise. The Mormon Republican governor of Utah Gary Hebert refused to go along with his homophobic, theocratic and Republican-dominated legislature to ban sex education or any mention of homosexuality in Utah schools.

Instead Gov. Hebert vetoed HB 363, as reported by Reuters:
In vetoing the measure, dubbed HB 363, Herbert said that as a parent and grandparent he considered proper sex education in public schools an important component to the moral education youngsters receive at home.

"If HB 363 were to become law, parents would no longer have the option the overwhelming majority is currently choosing for their children. I am unwilling to conclude that the state knows better than Utah's parents as to what is best for their children," he said.

"In order for parents to take on more responsibility, they need more information, more involvement, and more choice—not less. I cannot sign a bill that deprives parents of their choice," he added.

Supporters of the bill argued that sex education was best left up to parents.
When even the Republican Governor of Utah won't go along with your know-nothing policy agenda, don't you think perhaps you may have gone too far?

Apparently not. Here is what the Salt Lake Tribune attributed to HB 363 proponents (read it and puke!):

"It never entered our minds that the governor who told us he was conservative would veto such an appropriate piece of legislation," she said. "By vetoing this bill, he just sent the message that Utah’s stamp of approval [is] on teaching children how to have sex, teaching contraception and saying this is the safest way to have sex."
Sen. Margaret Dayton, co-sponsor of the bill, said she was disappointed the governor hadn’t contacted her to discuss his concerns and said teaching children about contraception is comparable to telling kids not to do drugs, then showing them how to "mainline" heroin.

Yes, a state senator did just compare teaching about contraception to promoting drug addiction. I really have no words in response. How can one engage in meaningful dialogue or debate with a raving lunatic? I bet she thinks mentioning homosexuality makes kids gay. But then again, she probably didn't have any sex education and wants to make sure that Utah produces more, ignorant, homophobic adults who share her views!

All I can say to the kids of Utah, "It Gets Better" (when you leave Utah)!

India Gov't Accepts Sodomy Legalization Ruling

The long strange story of India's sodomy law appears to be coming to a close with the demise of the colonial-era prohibition on gay male sexual acts appearing to be nigh. Today the Government of India clarified that it supports the previous decision by the Delhi High Court to decriminalize sodomy, despite a declaration before the Supreme Court last week that the Government felt that gay sex is "highly immoral" which was quickly officially denied.

The Associated Press has the story:
NEW DELHI (AP) — The Indian government Tuesday clarified to the Supreme Court that it accepts a recent ruling legalizing gay sex in the country.
A lawyer told the Supreme Court that the government would not challenge a 2009 order by the Delhi High Court striking down a colonial-era law that made gay sex a crime.
The order was appealed by conservative groups and the Supreme Court is now hearing opinions from those groups as well as gay rights activists.
The latest statement comes days after another government lawyer told the court that gay sex was "highly immoral" and should be banned. The government quickly denied that lawyer's statement, prompting confusion about its stance on the law.
On Tuesday, a Supreme Court justice asked the government's lawyers to file an affidavit to reconcile the two divergent positions heard in court. Neither lawyer explained Thursday's confusion.
The 2009 high court order had said that treating consensual gay sex between adults as a crime was a violation of fundamental rights protected by India's constitution.
If this decision gets confirmed it will be the single most significant advance in LGBT rights that will positively impact the most number of homosexuals in the world. India has a population which is estimated at 1.2 billion people.

Celebrity Friday: Nancy Pelosi Slaps The Homocons

Nancy Pelosi gave an incredible interview to The Advocate magazine where she discusses several issues. However, the quote the struck my eye (and Joe Jervis as well) was this:
"Oh, but what about them? He [Barney Frank] chooses a party that supports his values. They've chosen a party that supports their income — a party that denigrates them and treats them with disrespect."
Ouch!

AK and SD Only States Without Openly LGBT Elected

There are only two states in the Union which do not have a single openly LGBT elected official at any level: South Dakota and Alaska. Mississippi used to be on the list until last week when Mayor Greg Davis of Southhaven, MS admitted that he was gay after auditors found he had tried to get reimbursed for expenses at a an adult store while on a business trip to Canada!

According to Denis Dison at the Gay and Lesbian Victory Fund:
That doesn’t mean these states aren’t served by LGBT elected officials, just that none have self-identified publicly either in speeches or in the media.  But one group that supports out elected officials says there’s a reason this matters.
“It’s important that people know there are LGBT people serving in public office, especially in their own communities.  That doesn’t mean that LGBT issues are front and center in their work.  In some cases just being open and honest about that part of our lives has great potential to deepen understanding of our community, and that makes a huge difference,” said Tiffany Muller, Vice President for Programs at the Victory Institute.
The Victory Institute maintains the most up-to-date database of out LGBT officials available, and in recent years elected officials in states like Kansas, South Carolina, West Virginia and North Dakota have been added.  The group has a goal in 2012 of having identified at least one out elected official in every state in the U.S.  ”That will mark a really significant milestone for LGBT Americans, and it will be a symbol of how far we’ve come as a country,” Muller said.
Who wants to bet that there are closeted politicians serving in elected office in South Dakota and Alaska right now (and maybe getting a  little nervous)?

Celebrity Friday: Margaret Court Reveals Her Homophobia

Margaret Court is on top of the list of
all-time women's major singles tennis titleholders
Margaret Court is the legendary tennis player from Australia who won 24 women's major singles titles, more than any other player in history. Steffi Graf is the only modern player to come remotely close to breaking her record, with 22 major titles when she retired in 1999.

Court is widely considered tennis (and sports) royalty but the words that came out of her mouth were not very regal. Court gave her opinion about the ongoing national debate in her home country about whether Australia should end the exclusion of same-sex couples from civil marriage.

And what she said was not pretty.

"They are not perfect, often dysfunctional and despite the fact the role models may be distorted and even severely flawed, there is no reason to put forward alternative, unhealthy, unnatural unions as some form of substitute. No amount of legislation or political point-scoring can ever take out of the human heart the knowledge that in the beginning God created them male and female and provided each with a unique sexual function to bring forth new life. To dismantle this sole definition of marriage and try to legitimise what God calls abominable sexual practices that include sodomy, reveals our ignorance as to the ills that come when society is forced to accept law that violates their very own God-given nature of what is right and what is wrong."
Mrs. Court is now apparently "Reverend Court" and obviously does not understand the difference between civil marriage (which is a creation of the secular state) and a religious wedding. Mrs. Court is free to believe whatever she wants about how her religion views homosexuality but she is not free to impose those values upon other people who do not share her religious beliefs in a democratic, secular country like Australia.

Since two of the most venerated female tennis champions are openly lesbian you know that Martina Navratilova and Billie Jean King would not let such comments go by without a response.

According to the Tennis Channel this is how they responded:

Said Navratilova: “Seems to me a lot of people have evolved as has the Bible, [for example regarding] slavery. Unfortunately, Margaret Court has not. Her myopic view is truly frightening as well as damaging to the thousands of children already living in same gender families...I have tried to talk to Margaret, but to say she’s completely close-minded on the issue is an understatement...Here is hoping Australia will be on the right side of history and human rights, and become yet another democracy granting equal rights to all her citizens.”
Said King: "I respectfully disagree with Margaret’s position on gay marriage...We have to commit to eliminating homophobia because everyone is entitled to the same rights, opportunities and protection...The more we talk openly about issues like gay marriage, the more we learn about each other. It is a blessing the people of Australia can live freely and express their own opinions because we need open dialogue to help us move forward."
Good job by Martina and Billie Jean to let Mrs. Court know that her unbridled religious-based homophobia would not pass by unchecked. It's not often two of my favorite topics (tennis and LGBT equality) intersect but you know when they do I will blog about it!

Nigeria Senate Passes Insanely Anti-Gay Bill

Very bad news out of Nigeria. For the last 18 months or so the LGBT blogosphere has been tracking an anti-homosexuality bill in Uganda which included the death penalty for some homosexual acts. Happily that legislation died when the legislative session ended earlier this year, although there are some reports that Uganda's Anti-Homosexuality Bill is being revived.

Now comes news that an arguably even more repressively homophobic bill has passed one legislative body i Africa's most populous nation, Nigeria.

The Washington Post reports:

Nigeria’s Senate voted Tuesday to criminalize gay marriage, gay advocacy groups and same-sex public displays of affection, the latest legislation targeting a minority already facing discrimination in Africa’s most populous nation.
The bill, now much more wide-ranging than its initial draft, must be passed by Nigeria’s House of Representatives and signed by President Goodluck Jonathan before becoming law. However, public opinion and lawmakers’ calls Tuesday for even harsher penalties show the widespread support for the measure in the deeply religious nation.
“Such elements in society should be killed,” said Sen. Baba-Ahmed Yusuf Datti of the opposition party Congress for Progressive Change, drawing some murmurs of support from the gallery.
Gay sex has been banned in Nigeria, a nation of more than 160 million people, since colonial rule by the British. Gays and lesbians face open discrimination and abuse in a country divided by Christians and Muslims who almost uniformly oppose homosexuality. In the areas in Nigeria’s north where Islamic Shariah law has been enforced for about a decade, gays and lesbians can face death by stoning.

Harvey Milk May 22, 1930 – November 27, 1978

Harvey Milk, the most famous openly gay politician in U.S. history, was assassinated in San Francisco on November 27, 1978, 33 years ago today.

Bob Slatten of the blog I Should Be Laughing posted some of Harvey Milk's most memorable quotes today in remembrance. My favorite is:

“If a bullet should enter my brain, let that bullet destroy every closet door.”

Unfortunately, a bullet did enter Harvey's brain on that fateful day in November 33 years ago, but there are still far too many closeted people, especially politicians, often letting their internalized homophobia lead them into committing external acts of homophobia as well.

Zimbabwe PM Endorses Gay Rights

Prime Minister Morgan Tsvangirai of Zimbabwe
Surprising news out of Africa about homosexuality. The Prime Minister of Zimbabwe Morgan Tsvangirai has reversed himself and taken a position in opposition to President Robert Mugabe of Zimbabwe on whether LGBT rights should be protected under law.

The BBC reports:
Mr Tsvangirai told BBC's Newsnight programme that there was a "very strong cultural feeling" against homosexuality in Zimbabwe, but he would defend gay rights if he became president.

"It's a very controversial subject in my part of the world. My attitude is that I hope the constitution will come out with freedom of sexual orientation, for as long as it does not interfere with anybody," he told Newsnight's Gavin Esler.
"To me, it's a human right," he said.
Zimbabwe's long-time leader Mr Mugabe - a practising Christian - once said gays were "worse than pigs and dogs", sparking international condemnation.
In March 2010, Mr Tsvangirai said gay rights was not up for discussion in Zimbabwe.
This is excellent news.

Lesbian Federal Judicial Nominee Confirmed 48-44

Ridiculous!! A;most every Republican Senator, even Maine Senators Olympia Snowe and Susan Collins voted against the nomination of out lesbian Ali Nathan to have a lifetime appointment as a federal judge on Thursday. The nomination was approved by the surprisingly close vote of 48 Aye, 44 No.

Chris Geidner at MetroWeekly's Poliglot has the scoop:

Nathan, an out lesbian, will be the second out lesbian federal judge with lifetime tenure in the country, joining U.S. District Court Judge Deborah Batts on the bench of the Southern District of New York.
White House spokesman Shin Inouye praised the Senate action, writing, "The President welcomes the confirmation of Alison Nathan. She will serve the American people well from the District Court bench."

Five members of the Democratic caucus did not vote for Nathan's nomination, and no Republicans voted for it. Less than three months ago, U.S. District Court Judge J. Paul Oeken, was confirmed with the support of 28 Republicans. Oetken also sits on the Southern District of New York bench and currently is the only out gay male judge serving in one of the lifetime tenure positions in the federal judiciary.

Four Democrats not voting today were Sens. Kay Hagan (D-N.C.), Tom Harkin (D-Iowa), Joe Manchin (D-W.V.) and Debbie Stabenow (D-Mich.). Sen. Joseph Lieberman (I-Conn.), who caucuses with the Democrats, also did not vote. The three Republicans not voting were Sens. Tom Coburn (R-Okla.), Richard Lugar (R-Ind.) and David Vitter (R-La.).
It just goes to show you how much more seriously conservatives take the federal judiciary than liberals when they were willing to vote against this amazingly well-qualified person for basically illusory reasons.

DVD REVIEW: Latter Days

Finally saw a movie which was in our Netflix queue for over a month (sigh!) when I was back home in Los Angeles recently. The movie is Latter Days, which is about the romance between a West Hollywood muscle twink named Christian and a blonde, innocent 19-year-old Mormon missionary named Aaron.

Latter Days had been on our list of movies to see for a long time, since the Other Half was a Mormon missionary and word-of-mouth described the film as being a heartwarming gay love story.

Even with that much information about the film, I was still pleasantly surprised by Latter Days in two ways: the script and the cast. The director, C. Jay Cox, also wrote the screenplay, and (according to IMDB) apparently based it on his own life as a Mormon missionary who went to Los Angeles and turned into a West Hollywood gay party boy. One would expect the script for what is essentially a low-budget gay film festival flick to be trite and predictable but it repeatedly surprised me with plot twists. I kept on saying "I didn't expect THAT to happen!"--this is the mark of a well-written film that captures your attention and never lets go.

The other even more pleasant surprise was the cast. The biggest star in the movie (currently) is Joseph Gordon-Levitt, who was a child actor in television's 3rd Rock from the Sun but more recently has become famous for his non-threatening boy-next-door good looks in (500) Days of Summer and my favorite film of 2010, Inception. Jacqueline Bisset is also in the film, as the older sage and "den mother" who owns a restaurant in West Hollywood where Christian works as a waiter alongside his roommate Julie, an aspiring singer. The actors playing Christian, Wes Ramsey, and Aaron, Steve Sandvoss, are both very attractive in theor own way. Ramsay has a very muscular, low-fat, smooth body and a handsome face while Sandvoss has a very fit and athletic body coupled with classic blonde hair and blue eyes and a permanently innocent expression. It's fun to watch movies when there "eye candy" on the screen!

The one detraction I would make about Latter Days, although I think this was intentional choice by the writer/director to broaden the movie's appeal is that it is trying to span multiple genres simultaneously, possibly too many at once. At different points it wants to be a musical about starving artists making it in the big city, an AIDS buddy film, a Romeo and Julio love story, a gritty drama about religion and homosexuality, a (gay) sex comedy and, finally, a heart-warming story about self-actualization. It's probably a good idea for a small film to be about just more than one thing, but trying to be too many things at once can lead to a bit of dissonance as the film switches rapidly between tones.

All in all Latter Days is a very enjoyable experience, very much worth renting.

NFL Player-Owner Agreement Bans Anti-Gay Discrimination

This is another sign of the demise of the salience of homophobia in American life. The National Football League agreement between the players' union and the owners guarantees non-discrimination based on sexual orientation.
Section 1. No Discrimination: There will be no discrimination in any form against any player by the Management Council, any Club or by the NFLPA because of race, religion, national origin, sexual orientation, or activity or lack of activity on behalf of the NFLPA.
Hat/tip to Wide Rights! If you can't discriminate against gay soldiers or gay football players why should you be able to discriminate in 31 states against gay employees in private businesses?

Text of Anti-Gay North Carolina Ballot Measure

Below is the text of a constitutional amendment passed by the North Carolina legislature this week which purports to "protect marriage" by declaring that only  "marriage between one man and one woman is the only domestic legal union that shall be valid or recognized" in the State of North Carolina. The intent is similar to the odious (and unconstitutional) Proposition 8 in California and the still-to-be-voted on Minnesota amendment but the legislative language "domestic legal union" is novel. It will definitely ban any state recognition of marriage between same-sex couples and civil unions but it's not clear if it would ban the enactment of a limited statewide domestic partnership statute.NC Anti-Gay Constitutional Amendment

Likability Perceptions Vary With Sexual Orientation

Zack Ford over at the LGBT Think Progress blog calls attention to an interesting academic article which explores how the perceived sexual orientation of strangers changes their perceived likability.

The results in "Impressions at the intersection of ambiguous and obvious social categories: Does gay + Black = likable?" are published in Journal of Experimental Psychology:

In one study, 22 women and nine men viewed 104 photos of straight and gay black and white males and rated their likeability on a scale of one (not likable) to seven (extremely likable). Participants were not informed that some of the men pictured were gay. While overall, white straight men were rated as more likable than white gay men, black men were rated in the opposite manner: gay blacks were more likable than straight black men.
"We observed that people judge others based on sexual orientation even if they are not consciously aware of whether someone is gay or straight," said doctoral student Jessica Remedios, lead author. "By understanding how sexual orientation affects the rapid evaluations we form about others, we can learn more about predicting and minimizing the negative consequences of homophobia."
In a second study, 36 women and 14 men were divided into groups to view the same 104 photos. One group was instructed to approach whites and avoid blacks by pulling a joystick toward them when a white face appears and pushing the joystick away when a black face appears; the other group was instructed vice versa, to approach blacks and avoid whites. Among participants approaching whites, the responses were faster for the straight men than for the gay. Among participants approaching blacks, however, responses were faster for gay than straight men. "Given that faster approach responses indicate greater positivity toward stimuli, the second study is consistent with the liking expressed in the first study," says Remedios.
"These findings suggest that sexual orientation, despite lacking explicit perceptual markers, infiltrates the automatic impression that is formed. Further, our judgment of gay men depends on whether they are white or black."
Curious result, eh?
